These Terms govern your use of mcculloughai.com and any services provided by McCullough AI Business Solutions, a DBA of Gregory McCullough Enterprises (“we,” “us”). By using the site or engaging us, you agree to these Terms.

1. Our services

We design, build, install, and manage AI-powered systems (such as AI front-desk, follow-up, and automation agents) for businesses. The specific scope, deliverables, and fees for any engagement are set out in a separate Service Agreement.

2. Eligibility & applications

Our services are for businesses. Submitting an application does not create a contract or guarantee acceptance — we take a limited number of clients and review each application.

3. Payments

Unless your Service Agreement states otherwise, project work is billed 50% up front and 50% on delivery, and ongoing management is billed monthly. Full payment terms, guarantees, and refunds are described in our Refund Policy and Service Agreement.

4. Intellectual property

The site, our content, and our underlying methods, templates, and frameworks are owned by us. We grant you a license to use the systems we build for your business as described in your Service Agreement. You retain ownership of your own business data and content.

5. Acceptable use

  • Don't use the site or services unlawfully, or to send spam or unsolicited communications in violation of applicable law.
  • Don't attempt to disrupt, reverse-engineer, or gain unauthorized access to our systems.
  • You're responsible for complying with laws that apply to your own outreach and communications (e.g., CAN-SPAM, TCPA, and similar).

6. No guarantee of specific results

We work hard to deliver strong outcomes, but we do not guarantee specific revenue, bookings, rankings, or other results. Outcomes depend on many factors outside our control, including your offer, market, and follow-through. See our Disclaimer.

7. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount you paid us for the services giving rise to the claim.

8. Indemnification

You agree to indemnify us against claims arising from your misuse of the services or your violation of these Terms or applicable law (including your own marketing/outreach practices).

9. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in New York.

10. Changes

We may update these Terms; continued use after changes means you accept them.

11. SMS Messaging Program

McCullough AI Business Solutions operates an SMS text messaging program. By providing your mobile phone number and checking the SMS consent checkbox on our opt-in form at mcculloughai.com/sms-opt-in, you agree to receive text messages from us. Message types include appointment confirmations, service inquiry follow-ups, and promotional updates about our AI automation services for local service businesses.

  • To opt out at any time, text STOP in reply to any message. You will receive one final confirmation and then no further messages.

  • Message and data rates may apply. Consult your carrier for details.
  • Carriers (including AT&T, T-Mobile, Verizon, and others) are not liable for delayed or undelivered SMS messages.
  • You must be 18 years of age or older to consent to receive SMS messages from us.
  • Our Privacy Policy at mcculloughai.com/privacy governs how we handle your mobile number and consent data. SMS opt-in data is never sold, rented, or shared with third parties for marketing purposes.
